White x Space LLC Fulfillment Policy for Credit Card Payments via Stripe®
These policies help users understand how White x Space LLC fulfills orders and processes payments made by credit card via Stripe.
The following terminology applies to these Terms and Conditions, Privacy Statement, Disclaimer Notice, and all Agreements: “Client,” “You,” and “Your” refers to you, the person using this website and agreeing to the Company’s terms and conditions, either herein or under a separate written contract. “The Company,” “Ourselves,” “We,” “Our,” and “Us” refers to White x Space LLC. “Party,” “Parties,” or “Us” refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of assisting the Client in the most appropriate manner, expressly for the purpose of meeting the Client’s needs in respect of the provision of the Company’s services, in accordance with and subject to, the prevailing laws of the State of California. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and, therefore, as referring to the same.
Terms and Policies
Services Offered and Fees
White x Space LLC offers **Branding**, **Web Design & Development** services, but is not limited to these offerings. Additional services may be provided at our discretion, and they will be outlined in a separate agreement or proposal. Out-of-scope work may result in a revision of the original proposal or require a new proposal or contract. The fees listed in this document reflect the initial proposal. Any additional services requested by the client or provided by the agency may vary depending on the scope of work and the type of service required.
Payment Terms
Payment for services must be made in advance or as specified in a separate agreement or proposal. Failure to make timely payment may result in delays in service delivery or termination of the agreement. Clients may request a payment plan for larger payments, which will be at the discretion of White x Space LLC.
Fulfillment Policy
At White x Space, client satisfaction is a priority. This Fulfillment Policy informs you of our delivery and refund policies for services purchased from us. Please read this Policy carefully to understand your rights and obligations. Our services are billed in U.S. Dollars.
Delivery Policy
White x Space LLC provides digital design and marketing services. We deliver these services via electronic and telephonic means, as per the client’s requirements.
Refunds & Cancellations
Refunds may be provided under the following conditions:
If no services have been performed during the contract period.
For Cancellations:
Unless under a term contract, you can request cancellation at anytime with a 30 day notice.
Even with a term contract, cancellation can be requested, but White x Space LLC reserves the right to charge a 20% fee of the remaining value of the contract.
Exceptions:
Refunds will not be granted if:
- You received the service ordered but changed your mind.
- You were aware of or notified of issues with the service before purchase.
- You did not like or found no use for the service after purchase.
- You failed to report dissatisfaction within 7 days of receiving the service.
Monthly and Non-Monthly Services:
Both monthly and non-monthly service fees are non-refundable. If the Client cancels a monthly service before the end of the month, they will still be charged for the full month. The agency reserves the right to cancel monthly services with 30 days' notice to the Client.
Return Policy
White x Space LLC provides digital services. No returns are applicable, though refunds may be offered under specific conditions outlined above.
Intellectual Property and Confidentiality
White x Space LLC retains all rights to any intellectual property created during the course of providing services, including but not limited to social media content, graphics, and designs. We agree to maintain the confidentiality of all client information and will not disclose it to third parties without prior written consent.
Cancellation Policy
Once a contract with White x Space is signed, cancellations are not permitted unless otherwise stated. For All Monthly Services, Cancellations must be requested via an email to info@whitexspace.com 30 days in advance.
Project Abandonment
If the Client becomes unresponsive or fails to participate in the project for 30 days, White x Space LLC may consider the project abandoned. In such cases, refunds may be reduced or forfeited, and the Client agrees to this forfeiture of fees paid for the services outlined in the original Work Order.
Administrative Fee
All refunds are subject to a 7% administrative fee.
Liability and Indemnification
White x Space LLC is not liable for any damages or losses resulting from the use of its services. The Client assumes responsibility for using the services outlined within or outside this document. All members of White x Space LLC are indemnified from any claims, damages, or liabilities arising out of errors or omissions made in providing services, provided these errors are not the result of willful misconduct or gross negligence.
The company and its members are not liable for indirect, incidental, consequential, or special damages in connection with the provision of services, even if White x Space LLC has been advised of the possibility of such damages.
Terms and Termination
The Client agrees to the terms herein and to updated terms found at **whitexspace.com/terms**. Either party may terminate the agreement at any time with written notice. Upon termination, the client is responsible for payment for all services provided up to the date of termination.
Governing Law and Amendments
These terms and conditions are governed by and construed in accordance with the laws of California. They may be amended by the agency at any time without written notice. The most updated terms are available at **https://whitexspace.com/terms**.
Dispute Resolution
Disputes arising under this agreement shall be resolved through mediation. If mediation fails, the dispute will be resolved by binding arbitration under applicable arbitration rules.
Limitation of Liability
To the maximum extent permitted by law, the total liability of White x Space LLC for any claims, damages, or liabilities shall be limited as allowed by law. White x Space LLC shall not be liable for any amount beyond this limit.
Force Majeure
Neither party shall be liable for failure or delay in performance due to circumstances beyond its control, including but not limited to natural disasters, war, terrorism, strikes, or government actions. In such events, the affected party will promptly notify the other and take reasonable steps to mitigate the impact of the event on its performance under the Agreement.
How to Make a Complaint
If you are dissatisfied with our services and are eligible for a refund, please email **info@whitexspace.com** outlining your complaint. Refunds are issued at our discretion, based on investigation.
